Terms & Conditions of Service

Standard operational guidelines, client responsibilities, warranty conditions, and legal limitations governing all pest management services.

Please read these Terms and Conditions carefully before booking, scheduling, or utilizing any pest management services provided by Bright Star Pest Control. By confirming a service booking, you agree to be bound by the terms outlined below.

1. Scope of Agreement and Acceptance

These Terms and Conditions constitute a legally binding agreement between Bright Star Pest Control ("Company", "We", "Us", or "Our") and the client ("Client", "You", or "Customer") requesting residential, commercial, or industrial pest management services across Delhi, Noida, Gurugram, Ghaziabad, Faridabad, Greater Noida, and surrounding NCR territories.

Service confirmation via telephone, WhatsApp, online inquiry form, written quotation, or on-site verbal acceptance signifies full consent to these operational terms and conditions.

2. Inspection and Diagnostic Scope

Initial inspections and site assessments evaluate visible and accessible areas of the premises to identify active infestations and environmental harborages:

  • Accessible Areas: Assessments are confined to spaces safely accessible to our technicians at the time of inspection.
  • Inaccessible & Concealed Zones: The Company does not guarantee discovery of infestations inside concealed structures, including sealed false ceilings, interior wall cavities, locked storage units, sub-flooring, under heavy fixed cabinetry, or inside enclosed ductwork.
  • Advisory Quotations: Recommended treatment plans and cost estimates are based on observed conditions. Should severe hidden infestations or structural complications emerge during service execution, revised estimates will be discussed prior to proceeding.

3. Client Obligations and Safety Protocols

The safety of occupants, children, and pets depends upon strict adherence to pre-treatment preparation and post-treatment safety protocols:

  • Pre-Service Preparation: The Client must ensure that all exposed food items, cooking ingredients, drinking water containers, baby items, kitchen utensils, and pet bowls are properly covered or placed inside sealed cabinets prior to treatment.
  • Premises Evacuation: During chemical spray or misting treatments, all residents, children, elderly persons, and household pets must vacate the treatment area for the duration advised by our team (typically 2 to 4 hours).
  • Ventilation Prior to Re-entry: Upon returning, the premises must be thoroughly ventilated by opening windows and doors for at least 30 minutes before prolonged re-occupation.
  • Pre-Existing Health Conditions: The Client is obligated to inform our service team in writing prior to service commencement if any occupant has asthma, respiratory sensitivities, chemical allergies, or is pregnant. Bright Star Pest Control disclaims liability for allergic reactions when prior medical disclosure was not provided or ventilation instructions were ignored.
  • Site Access & Utilities: The Client shall provide unhindered access to the premises, along with reasonable electricity and water required to operate professional equipment.

4. Pre-Existing Structural Damage and Utility Disclaimers

Pest infestations—particularly subterranean termites, wood borers, and rodents—inflict unseen structural, electrical, and cosmetic damage before professional intervention:

  • Pre-Existing Damage: The Company is not responsible for structural failure, wood hollow decay, wall plaster flaking, or electrical short-circuits resulting from pre-existing pest activity.
  • Concealed Utilities & Drilling: Specialized anti-termite treatments require drilling along floor-wall perimeters and door frames. The Client must point out the location of concealed plumbing pipes, gas lines, underfloor heating, or electrical conduits. In the absence of architectural drawings or explicit markings provided by the Client, the Company assumes no liability for accidental puncture or damage to unmarked concealed lines.
  • Cosmetic Restorations: Drill holes are sealed using standard white cement or mortar fillers. While technicians take professional care during sealing, minor color or texture variations compared to existing grout or flooring are normal and do not constitute defective workmanship.

5. Warranty and Service Guarantee Terms

Bright Star Pest Control adheres to realistic, professional service standards without making misleading claims:

  • General Disinfestation: Single-session treatments for cockroaches, ants, flies, mosquitoes, or seasonal pests do not carry unconditional blanket or lifetime warranties. Pest prevention depends directly on ongoing environmental sanitation, food storage hygiene, and structural proofing.
  • Qualifying Warranties: Formal written warranties apply exclusively to qualifying specialized treatments—specifically certified Drill-and-Inject Anti-Termite treatments or contracted Annual Maintenance Contracts (AMC)—as explicitly documented on the issued service invoice or warranty certificate.
  • Warranty Retreatment Process: Under an active qualifying warranty, if pest activity re-emerges in treated zones, the Company provides targeted re-inspection and retreatment at no additional service cost during the warranty term.
  • Warranty Voidance Conditions: Any issued warranty becomes immediately null and void if:
    1. Civil modifications, floor replacement, tile renovation, or carpentry alterations compromise the chemical treatment barrier without notifying the Company for re-sealing.
    2. Plumbing leaks, wall dampness, roof seepage, or water logging occur in treated zones, washing away chemical residues.
    3. Untreated, infested furniture or timber is subsequently introduced into the treated property.
    4. The Client applies incompatible over-the-counter chemicals or engages third-party pest control providers in the treated area during the warranty tenure.
    5. Suspected pest activity is not reported to the Company within 14 days of initial re-sighting.

6. Pricing, Invoicing and Payments

Service charges are based on the agreed quotation and scope of work:

  • Settlement of Dues: Payments are due immediately upon completion of service, payable via authorized digital methods (UPI, bank transfer, cards) or cash against an official receipt or tax invoice.
  • Commercial AMC Billing: Corporate and commercial accounts will be billed according to the agreed milestone schedule stipulated in the respective AMC agreement.
  • Applicable Taxes: Goods and Services Tax (GST) is levied as applicable under statutory regulations.

7. Rescheduling and Cancellation Policy

Clients may reschedule or cancel scheduled appointments with reasonable advance notice:

  • Cancellation Notice: Cancellations or rescheduling requests must be communicated at least 6 hours prior to the scheduled technician arrival time.
  • Non-Refundable Services: Once technicians have reported on-site and chemical application has begun, the service fee is non-refundable.

8. Limitation of Liability

To the maximum extent permitted under applicable Indian law:

  • The total aggregate liability of Bright Star Pest Control, its proprietors, and technicians for any verified claim arising out of or connected with the services shall be strictly capped and limited to the total service fee actually paid by the Client for the specific service contract in question.
  • Under no circumstances shall the Company be liable for indirect, consequential, punitive, or special damages, including loss of rental income, business interruption, or alternative accommodation expenses.

9. Force Majeure

Neither party shall be held liable for failure or delay in performance caused by circumstances beyond reasonable control, including extreme weather events, natural disasters, municipal restrictions, curfews, civic strikes, or government emergency directives.

10. Dispute Resolution and Governing Jurisdiction

These Terms and Conditions shall be governed by, construed, and enforced in accordance with the laws of the Republic of India.

Any controversy, claim, or dispute arising out of or relating to these terms or services provided shall be subject to the exclusive legal jurisdiction of the competent courts situated in New Delhi / Delhi, India.
